A UN study done by International Agency for Research on Cancer had concluded that the risk of breast cancer is more for employees who work night shift for long durations. The study was based on a group of nurses and flight attendants, who had worked for more than 30 years in night shifts, and had shown an increased risk of breast cancer.

The report came almost immediately into play when the Danish government decided to declare the night shift working related breast cancer as an industrial injury and thus made it eligible for compensation. About 40 women have been paid compensation so far for their disease as a result of working night shifts for as long as 20 to 30 years. These women had no other possible causes for their cancer.

Brendan Padfield, Head of Personal Injury at international law firm Eversheds, has said commenting on the issue that employers must be aware of the dangers this situation could bring, especially in the form of increased litigation. He also advised the employers to make an assessment of the risk of breast cancer for night shift workers and warn them about the same. He suggested that these initiatives could help them in the long run if compensation was demanded from them. Although, there were still doubts about the UK’s decision regarding this latest development and the UN report, Brendan Padfield warned employers to be ready for any eventuality. He also believed that the lack of any directive from The Health and Safety Executive was by no means an indication to be complacent because another EU government had already been acting on the issue and paying compensation for it.
